When you use our website you agree to these Terms & Conditions (the “Terms”) listed below. Booking and taking part in a tour (land, air or sea carriage also included) or related service and products, you also agree to the terms below.

CONTRACT BOOKING 

18+ years of age  are permitted to book only. You agree to provide full, complete and accurate information. When booked a confirmation and a contract exists and is bounded by terms and conditions listed.

Your booking is confirmed and a contract exists when the Tour company and/or independent contractors t issues a written confirmation after receipt of the applicable deposit amount. 

It is your responsibility to check your confirmation carefully and report any incorrect or incomplete information to the Tour company and/or independent contractors immediately. Please ensure that names are exactly as stated in the relevant passport.

When  booking on behalf of others: 

By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. 

You are responsible for making all payments due in connection with your Tour booking, notifying the Tour company and/or independent contractors  if any changes or cancellations are required and keeping your party informed. You  also represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and the Tour company and/or independent contractors  will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.

Special requirements you may need 

Special requirements must be disclosed  at the time of booking. 

Reasonable attempts  to accommodate  any special requirements or requests will be made  but this is not always possible given the nature of the destinations visited and availability.

Food allergies and dietary restrictions must be disclosed at the time of booking, no guarantee can be made  however dependent on the tour.

Medical required  information

You must provide when booking any medical information you believe may be important and needs to be considered life threatening or otherwise. 

Medical Forms are mandatory for certain Tours. If you have any pre-existing medical conditions which may impact your ability to travel, participate in a Tour, travel to remote areas without access to medical facilities or may adversely affect the experience of others on your Tour, you must return a Medical Form  and receive confirmation from Tour company and/or independent contractors . 

 The Tour company and/or independent contractors will maintain the information in accordance with the Tour company Privacy Policy.

The Tour company and/or independent contractors reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour.

The Tour company and/or independent contractors reserves the right to deny you permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense where the Tour company and/or independent contractors determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others.

Pregnancy is considered a medical condition and must be disclosed to the Tour company and/or independent contractors at the time of booking. The Tour company and/or independent contractors may refuse to carry women who are over 24 weeks pregnant. The Tour company and/or independent contractors may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.

In the event that you do not complete the required Medical Form or provide medical information reasonably required by the Tour company and/or independent contractors for any reason by the deadline indicated above, the Tour company and/or independent contractors reserves the right to cancel your booking and all applicable cancellation fees will apply.

You are responsible for assessing whether a Tour is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician’s advice on vaccinations and medical precautions. The Tour company and/or independent contractors does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements.

Travel with the Tour company and/or independent contractors may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Tour varies and the Tour company and/or independent contractors makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.

Age Restrictions 

You are considered a minor if you are  under the age of 18 on the date of travel and must be accompanied by an adult at all times. 12 years old is the minimum age for minors traveling on any Tour., bookings with a minor are subject to review and approval by the Tour company and/or independent contractors . If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. 

The Tour company and/or independent contractors  will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.

Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behavior, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. The Tour company and/or independent contractors does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).

Insurance requirements  is mandatory 

 Each Guest (adult or minor ) must have travel insurance with at least US$200,000  MEDICAL, EVACUATION AND REPATRIATION COVERAGE which covers all applicable dates of travel with the Tour company and/or independent contractors . This insurance must cover personal injury and emergency medical expenses. 

It is  strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling. 

You acknowledge that insurance coverage is not included in the cost of any Tour offered by the Tour company  and you are required to obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage.

Prices, surcharges and taxes

Tours includes applicable taxes. 

We may offer tours at reduced pricing on certain products or services, discounts are only applicable to new bookings. 

Once Tours are booked, tour price will never increase. 

Tour company and/or independent contractors  has the right to impose surcharges on any products or services booked for reasons arising from increases in transportation costs, fuel costs, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airport charges, local company costs, currency and exchange fluctuations, increases in taxes, or government action which impacts the price of the applicable products or services, after a confirmation is it is greater than 3% of the original price paid. 

If the necessary increase is more than  8% of the original price of the applicable tour, you may choose to either:(1 ) cancel the booking without incurring any penalty; or(2) accept the change of price.

Notification must be given to tour company and/or independent contractors within 14 days of receipt of notice to increase tour price. 

Validity of Tour 

Itineraries, dates and prices of tours may be changed at anytime and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance with these Terms.

Booking using this website or our services too  acknowledge that you are responsible for keeping up to date on the specific details of your Tour and any other products or services, including, but not limited to checking the our website at least 90 hours prior to departure as minor changes may have been made after the time of booking.

Deposit Rules 

Non-refundable deposit in the amount specified on our website is required to secure any booking. 

Booking made  60 days or less prior to departure, full payment is due at the time of booking. 

Booking cancellation resulting to non payment, deposit transferred to credit  (no cash value ) that may be used within 1 year (depending on availability of tour ), this credit is not transferable but may be applied to any other tours. Credit  (no cash value )will not be valid after 1  year. 

Booking  cancellation except for non payment credit  (no cash value ) will be valid for any tour within 5 years and are transferable within that period of time. Credit (no cash value )will not be valid after 5 years. 

Booking  information  needed 

 Information requested by the Tour company and/or independent contractors along with final payment must be provided.  Information that may be required but not limited to are air tickets, permits, proof if travel insurance. 

Failure to provide the necessary information may result in tour  cancelled and levy any cancellation fees deemed reasonable by the Tour company and/or independent contractors .

 Tour company and/or independent contractors   information required  will vary by Tour and will be communicated to you or to the Tour company’s authorized agent during the booking process. Tour companies will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.

Flight and Airfare

Airfare  are not included in any tours, internally or domestic. Any estimate / quotes given are  not a firm price commitment and should be considered as only examples of cost. Tour company and/or independent contractors cannot be made  responsible for any changes in air itineraries or flight times and does not provide advice or alerts regarding air travel tickets, flight status or delays.

Balance of Payment 

All payments / deposits must be completed within 60 days of travel.  The tour rate  may be  changed  or be treated  as cancelled and  the deposit may be retain  as a cancellation fee.

Tour companies are not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to the Tour company and/or independent contractors .

Cancellation by Guest

Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by the Tour company and/or independent contractors and are expressed as a percentage of the total price paid for the cancelled Tour, product or service (excluding any insurance products) when the tour is cancelled by guest.

Cancellation of a Tour:

(1) Cancellation must be received  within 0 – 60 days or more before departure of first product or service in related booking: There are no cash refund, Deposit will be help on account for a period of 2 years.
(2) Cancellation received  more  than 60 days before departure of first product or service in related booking: Half the Deposit will be held by the Tour company and/or independent contractors  in accordance with these Terms, an amount equal to 50% of the remainder of the payments made to the Tour company and/or independent contractors in respect of the cancelled Tour will be refunded to the same method of payment.

Cancellation and guaranteed departures

All Tour  scheduled departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. 

Guaranteed departure  is made when at least one booking secured by a valid deposit has been made on that tour departure.

Guarantee is not applicable in the case of Force Majeure. 

Up to date Tour and itinerary information will be provided on the Tour company’s website or by contacting the Tour company and/or independent contractors , notification may also be given using printed materials or brochures.

Departure dates are subject to change may not be relied upon for purposes of this guarantee.

If a Tour is cancelled by the Tour company and/or independent contractors  before the date of departure due to Force Majeure or as a result of a suspension of operations by the Tour company and/or independent contractors and the cancellation is not caused by your fault or negligence, the Tour company and/or independent contractors  can offer you either:
(1) a travel credit valued at 120% of monies paid for your Tour; or
(2) a refund minus unrecoverable costs.

Cancelled  of tour by company before the date of departure for reasons other than Force Majeure or as a result of a suspension of operations by the Tour company and/or independent contractors, and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from the company:
(1)Another Tour of equivalent or superior value; or
(2) Another Tour of lesser value if no Tour of equivalent or superior value is reasonably available and to recover from the Tour company  and/or independent contractors the difference in price between the price of the Tour originally purchased and the substitute Tour; or
(3) Full refund of all all monies paid for the cancelled Tour.

If a cancellation due to Force Majeure or a suspension of operations by the Tour company and/or independent contractors occurs after the Tour has commenced, the Tour company  and/or independent contractors can offer you either a pro-rata:
(1) travel credit valued at 120% of the monies paid for the days that remain on your Tour; or
(2) refund minus unrecoverable costs of the days that remain on your Tour. 

Any travel credit the Tour company  and/or independent contractors  issues as a result of a Tour that is cancelled for Force Majeure:
• An expiration date that is no sooner than 2 years from the date of Tour cancellation;
• Not redeemable for cash; and
•Excludes all  flights or insurance.

Visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment and any other misc expenses, Tour company and/or independent contractors  is not responsible for any incidental expenses or consequential losses for matters stated.  Tour company and/or independent contractors   reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. 

If a significant part of a Tour as described cannot be provided after departure, the Tour company and/or independent contractors  will make suitable alternative arrangements where possible. 

If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, the Tour company and/or independent contractors  may provide you with a refund for unused products or services as determined in its discretion.

Travel documents

It is your SOLE  responsibility  to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. 

Including  and not limited to a valid passport (that is valid 6 months after the last date of travel in each country or tour / activity )and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. 

You agree and accept FULL responsibility for the full amount of any loss or expense incurred by the Tour company  and/or independent contractors that is a direct result of your failure to secure or be in possession of proper travel documentation. 

The Tour company and/or independent contractors does not provide advice on travel documents and makes no representations or warrantees as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that the Tour company  and/or independent contractors  is not responsible for any errors or omissions in this information.  You are  therefore entirely responsible for the full amount of costs incurred as a result of missing or defective documentation.

Tour Changes Or Adjustments 

Route, activities, schedules, accommodations, amenities and transportation type are subject to change without notice due to unforeseeable circumstances or events outside the control of the Tour company and/or independent contractors   (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of the Tour company and/or independent contractors , including your removal from a Tour because of your negligence or breach of these Terms. 

The nature of  tours will sometimes need alterations to products, services or itineraries by the Tour company and/or independent contractors .

Adjustments 

Tour company and/or independent contractors may adjust your itinerary where reasonably required in its sole discretion. 

If the Tour company and/or independent contractors makes a change affecting  tour / service, the  Tour company and/or independent contractors will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure.

 If a Change is made more than 14 days before departure, you have options below, however  your choice  must be communicated to Tour company and/or independent contractors  within 7 days of receiving notice or you will be deemed to accept the amended itinerary :
a) Proceed with the amended product or service with acceptance ;
b) book another product or service of equal or greater value, if available (price difference will be paid by you); or
c) book another product or service of lesser value, if available (price difference will be refunded ); or
d) cancel the amended product or service and receive a full refund for the land-only portion of the applicable product or service (a refund is only given for the prorated changed portion of the tour).

Tour changes due to  unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort after departure, changes are at the discretion of the Tour company and/or independent contractors, the same options are given: 

a) Proceed with the amended product or service with acceptance ;
b) book another product or service of equal or greater value, if available (price difference will be paid by you); or
c) book another product or service of lesser value, if available (price difference will be refunded ); or
d) cancel the amended product or service and receive a full refund for the land-only portion of the applicable product or service (a refund is only given for the prorated changed portion of the tour).

It is your sole responsibility to have reasonable financial resources to cover incidental expenses during all travel with the Tour company and/or independent contractors , whether or not such expenses arise from ( direct/indirect) a change of itinerary, and the Tour company and/or independent contractors  is not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during travel. 

Your Changes 

You are Solely responsible for ensuring that information provided to the Tour company and/or independent contractors is accurate and up-to-date, you agree and accept FULL responsibility for the full amount of any cost due to changes that needs to be made. If these changes leads to cancellation of any Tour, product or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms.

No changes are permitted to any booking within 14 days of departure of the first product or service on the applicable booking.

Risk Acceptance 

By using any of our services you acknowledge that some tours may involve may involve a significant amount of risk to your health and safety. By traveling with the our tour company and/or independent contractors you acknowledge that you have considered any potential risks to health and safety and accept sole responsibility for  financially or otherwise.  You assume full  responsibility for all such risks and release the Tour company and/or independent contractors from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by the Tour company and/or independent contractors . Confirmation of  assumption of this responsibility may be required on some tours and or waivers needs to be signed.

Some products or services booked and the location(s) are riskier than others, despite the risk level of any tour or services, You are aware that you take Full Responsibility. 

It is the sole responsibility of each participant / traveler to become informed / aware or of any or all local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a Tour, product or service is operated. 

It is mandatory that you comply with all applicable laws and regulations of all countries and regions. Failure to do so may be considered as an illegal act and Tour company and/or independent contractors  may terminate your travel arrangements on any product or service immediately at your expense and without any liability on the Tour company’s part. No refund will be granted in this case and  you are responsible for any or all expenses incurred in this case.

It is your responsibility to follow any and all safety instructions and use of safety devices while on any tour.

All  complaints must be brought to the Tour company and/or independent contractors  as soon as possible in order to provide the Tour company and/or independent contractors  with the opportunity to properly address such complaint.

The Tour company and/or independent contractors assumes no liability for complaints that are not properly brought to the attention of the Tour company  and/or independent contractors and cannot resolve or attempt to resolve complaints until proper notice is provided. 

All complaints must be received in writing by the Tour company and/or independent contractors  within 30 days of the last day of travel of the booking in question.

The Tour company and/or independent contractors is not liable and will not assume responsibility for any claims, loss of enjoyment, upset, damages, losses,  costs or expenses arising out of inconvenience,  disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party other than the Tour company and/or independent contractors  and its employees.

You agree that  the TOUR company  and/or independent contractors is not responsible for any 3rd party supplier or sub-contractor. 3rd party suppliers  or sub-contractors are sometimes used for transportations ( land/water) and certain parts of the tours. . 3rd party suppliers  or sub-contractors has their own terms of you that you agree to abide by and follow. Therefore  the Tour company and/or independent contractors  is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.

You understand  and agree that any liability for damages,  illness, emotional distress, loss, death, personal injury, mental suffering or psychological injury or loss of or damage to property associated with any tour is the sole responsibility of the third party providing that service or activity.

Payment and Cancellation: 

Full amount due for any Tour is due 90 days before the departure date of the first product of service on your booking. Failure to make full payment may lead to a  change in the  rate payable or may treat the booking as cancelled and may, in its sole discretion, retain the deposit paid on booking as a cancellation fee.

Full amount is payable at the time of booking if booking date is less than  90 days before the departure date.

Cancellation fees may be imposed if you fail to make full payment or Cancel the turn. 

Company liability

The Tour company and/or independent contractors subsidiaries and their affiliates, respective employees, directors, officers, members, successors, representatives, and assigns shall not be held liable for 

any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against the Tour company and/or independent contractors  for any such loss, damage, injury, or death.

Loss of property, injury,  any damage to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any watercraft, aircraft, or vehicle operated or provided by such other provider; and 

In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of the Tour company and/or independent contractors  or of the Third Party Suppliers of any services which form part of the booking contract then the Tour company and/or independent contractors  limits its liability, where applicable by all applicable international conventions.

For claims not involving personal injury, death or illness or which are not subject to the Conventions referred to in the terms and agreement, any liability the Tour company and/or independent contractors  may incur for the negligent acts or omissions of its suppliers will be limited to a maximum of the price which you paid for the applicable Tour, not including insurance premiums and administration charges. Where this relates to loss or damage to luggage and other personal possessions then the Tour company  and/or independent contractors liability will not exceed $1,000 USA. 

The Tour company  and/or independent contractors will not at any time be liable for any loss of or damage to valuables of any nature. You accept and agree that you will be precluded from making a double recovery by making the same claims and seeking recovery against the Tour company and/or independent contractors  and its suppliers, contractors or other third parties.

The Tour company and/or independent contractors  will not in  be liable to you for any loss or anticipated loss of profit, loss of revenue, loss of enjoyment, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature in any circumstances.

Force majeure

The Tour company and/or independent contractors  will not be liable or responsible in any way for bodily injury, illness, death, damage, delay or financial costs both direct and indirect incurred, or other loss or detriment to person or property,  or for the Tour company and/or independent contractors  failure to commence,  delay, perform or complete any duty owed to you if such death, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and the ongoing effects of, Covid-19 or SARs-COV2, or any other cause whatsoever beyond the reasonable control of the Tour company and/or independent contractors  or the Third Party Supplier of services, whether or not foreseeable, which would make it dangerous or not viable for a Tour to commence or continue, any and all of which, individually and collectively, constitute “Force Majeure”.

Marketting, Images, Viedeo, Any other Media types 

You agree  and consent that, while participating / using in any Tour, images, photos or videos may be taken by other participants, the Tour company and/or independent contractors  or its representatives that may contain or feature you. 

You  agree and  give consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to the Tour Operator, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

 In event of severability:  If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or un-enforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

 Law applicable: The Contract and these Terms are subject to the laws of Florida, USA where the company is registered  and you submit to the exclusive jurisdiction of the courts located in Florida, USA   for the resolution of any dispute under these Terms or concerning any Tour, product or service.

Successors and or contract parties  are also bounded by these  Terms  and will inure to the benefit of and be binding upon the parties and their respective heirs, executors,  legal and personal representatives, estate trustees, successors and assigns.

Changes / Amendments: The Tour company and/or independent contractors  can update or alter these Terms at any time.In event Terms is updated it will be posted on the Tour Operator’s  terms and agreement section of the website with the effective date posted above highlighting the changes. You are deemed to have accepted any amendments to these Terms on the date that it is posted effective with at 14 days notification from date of change or amendment on the website.
